This sweepstakes (the "Promotion") is offered by Nestlé Waters North America (“Sponsor”) and by Fiesta Mart, Inc. ("Fiesta").
Sweepstakes starts on 07/28/2011 and ends on 08/26/2011 (the “Promotion Period”).
1. HOW TO ENTER:TWO WAYS TO ENTER: 1) Mail-in: complete an official entry form found at participating Fiesta stores, or on a 3” x 5” index card; hand print your complete name, address, birth date, email address (optional) and daytime phone number. Mail your entry in a #10 envelope with first-class postage affixed, to: Fiesta & Nestlé Pure Life Sweepstakes, PO Box 5008, Clinton, IA 52736-5008) Online: you may enter online at http://www.foodcity-npl.com by completing the online entry form and submitting the entry form during the Promotion Period. Limit one entry per day per person regardless of entry method; one entry only per outer mailing envelope if entering by mail. No mechanically reproduced entries will be accepted . Automated methods of entry are prohibited. Mail-in entries must be postmarked by 08/26/2011 and received by 09/02/2011 to be eligible. Sponsor is not responsible for lost, late, postage due, mutilated, illegible or incomplete entries. Electronic entries must be received by 11:59:59 p.m. CDT on 08/26/2011. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections whether human or technical in nature. 2. RANDOM DRAWING:A random drawing to select the prize winners will be conducted on or about 09/08/11 from among all eligible entries received by an independent judging agency (the "Promotion Fulfillment Center") whose decisions on all matters relating to this sweepstakes are final. Winners will be notified by phone and mail.
3. PRIZES AND APPROXIMATE RETAIL VALUES: One (1) Grand Prize:One (1) Grand Prize Winner will receive a Healthy Fun Package for a family of four (4)which consists of a Wii Fit, four (4) pairs of roller blades with helmets sports gear selected by Sponsor in its sole discretion for four (4) people, one (1) $500 Fiesta gift card and one (1) year’s supply of Nestlé® Pure Life® Purified Water to be awarded in the form of twenty-four (24) coupons, each coupon good for one (1) case of 0.5L size bottles (approximate retail value: $ 2000). Ten (10) First Prize winners will each receive one (1) $50 sporting goods gift card, one (1) $50 Fiesta gift card and one (1) year’s supply of Nestlé® Pure Life® Purified Water to be awarded in the form of twenty-four (24) coupons, each coupon good for one (1) case of 0.5L size bottles (approximate retail value per first prize: $220). Five (5) Second Prize winners will each receive one (1) $25 Fiesta gift card and six (6) months supply of Nestlé® Pure Life® Purified Water to be awarded in the form of twelve(12) coupons, each coupon good for one (1) case of 0.5L size bottles (approximate retail value per second prize: $185). Prizes consist only of the items specifically listed as part of that prize. Approximate total retail value of all prizes is $5,200.
4. GENERAL RULES:Odds of winning are based upon the number of eligible entries. This sweepstakes is open only to legal U.S. residents, residing in Texas, who are 18 years of age or older at the time of entry. Employees of Nestlé Waters North America, Fiesta Mart, Inc., CSA Marketing, Promotion Fulfillment Center and the respective representatives, affiliates, subsidiaries, distributors, advertising and promotion agencies, retailers, the immediate family members and/or those living in the same household of each are NOT ELIGIBLE. This sweepstakes is void outside Texas and wherever prohibited by law, and is subject to federal, state and local laws and regulations. All federal, state and local taxes on prizes are the sole responsibility of winners. The potential winners will be contacted by phone and mail, and will be required to execute an Affidavit of Eligibility/Release of Liability/Prize Acceptance form within seven (7) days of attempted notification. Return of any prize notification or prize as undeliverable will result in forfeiture of prize by winner and an alternate winner will be selected. By entering the Promotion, entrants agree to release and hold harmless, Nestlé Waters North America, Fiesta Mart, Inc., CSA Marketing and Promotion Fulfillment Center, and their respective distributors and retailers, affiliates, subsidiaries, advertising and promotion agencies, as well as their respective affiliates, officers, directors, agents, employees and assigns, from and against any claim, damage, liability or cause of action arising out of participation or attempt to participate in the Promotion or receipt or use of any prize. Promotion participants and prize winners release and agree to indemnify and hold Nestlé Waters North America, Fiesta Mart, Inc., CSA Marketing and Promotion Fulfillment Center, and their respective distributors and retailers, affiliates, subsidiaries, advertising and promotion agencies, as well as their respective affiliates, officers, directors, agents, employees and assigns, harmless against any and all claims and liability arising out of acceptance, possession, use or misuses of any prize, or participation in this Promotion.
Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Promotion or use or redemption of any prize. Acceptance of prize constitutes permission to use winner’s name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By participating in this Promotion, entrants agree to be bound by the official rules and the decisions of the Sponsor which shall be final. No substitution, cash redemption or transfer of prize is permitted, except Sponsor reserves the right to award a prize of equal or greater value, in its sole discretion, if featured prize becomes unavailable. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by any technical or human error which may occur in the processing of the entries in the sweepstakes. In the event Sponsor is prevented from continuation of this Promotion, or the integrity and/or feasibility of the Promotion is severely undermined by any event beyond Sponsor’s control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify or suspend, the Promotion without further obligation. If Sponsor, in its discretion, elects to abbreviate, modify or suspend the Promotion as a result of a Force Majeure event, Sponsor reserves the right, to award the prizes from among all valid and eligible entries received up to the time of such Force Majeure event, in a random drawing, provided entries have not been destroyed by such Force Majeure. Limit one prize per household or family.
